Abstract

The purpose of this work is to study the issue of the effectiveness of the criminal law norms to minimize the consequences of environmental pollution, including the consequences related to human genetic health. The article assesses the importance of the protective function of the criminal law norms, regulating responsibility for environmental crimes for the protection of human genetic health. Using the formal legal method, an assessment was made of the dispositions of a number of environmental crimes, and in particular the corpus delicti provided in Part 1 of Article 251 of the Criminal Code of the Russian Federation (air pollution), in terms of the formulation of criminal consequences, including points of their delimitation from the related administrative offenses. In the results of the study, the author of the paper defined the questions for further discussion on improving the elements of environmental crimes.
